• Contractual necessity: Processing required to fulfill our obligations under the AcePHP Terms and Conditions, including account management, payment processing, and game provision.
• Legal obligation: Processing required to comply with applicable Philippine laws and regulations, including PAGCOR licensing requirements, anti-money laundering obligations, and tax reporting requirements.
• Legitimate interests: Processing necessary for AcePHP's legitimate business interests, including fraud prevention, platform security, and service improvement, where such interests are not overridden by your rights and freedoms.
• Consent: Processing based on your freely given, specific, and informed consent, such as the sending of marketing communications. You may withdraw your consent at any time without affecting the lawfulness of processing carried out prior to withdrawal.

7Data Sharing and Disclosure

AcePHP does not sell your personal data. We may share your personal data with the following categories of recipients only to the extent necessary for the stated purpose:

• Payment processors: GCash, PayMaya, BPI, BDO, Metrobank, and other payment service providers, for the purpose of processing your financial transactions.
• KYC and identity verification providers: Third-party services engaged to verify your identity and age as required by Philippine gaming regulations.
• Anti-money laundering (AML) compliance partners: Service providers that assist AcePHP in meeting its obligations under the Anti-Money Laundering Act of 2001 (RA 9160) and its amendments.
• IT and platform service providers: Cloud hosting, data storage, and software providers who process data on AcePHP's behalf under strict data processing agreements.
• Regulatory authorities: PAGCOR, the National Privacy Commission, the Anti-Money Laundering Council (AMLC), and other competent Philippine government authorities, where disclosure is required by law or regulatory order.
• Law enforcement: Philippine law enforcement agencies, where disclosure is required by a valid court order, subpoena, or other legal process.

8Data Retention

AcePHP retains your personal data for as long as is necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements.

The following general retention periods apply:

• Account and identity data: Retained for the duration of your account and for a minimum of five (5) years following account closure, in accordance with Philippine anti-money laundering regulations.
• Financial transaction records: Retained for a minimum of five (5) years from the date of the transaction, as required by applicable Philippine law.
• Gaming history: Retained for a minimum of three (3) years from the date of the gaming session.
• Customer support communications: Retained for two (2) years from the date of the last communication.
• Marketing consent records: Retained until you withdraw your consent, plus one (1) year thereafter for compliance documentation purposes.

Upon expiry of the applicable retention period, AcePHP will securely delete or anonymize your personal data in accordance with our data disposal procedures.

11Children's Privacy

The AcePHP platform is strictly intended for individuals who are 21 years of age or older, in accordance with Philippine gaming regulations. AcePHP does not knowingly collect personal data from individuals under the age of 21.

If AcePHP becomes aware that personal data has been collected from a person under 21 years of age, we will take immediate steps to delete that data and close the associated account. If you believe that a minor has registered on the AcePHP platform, please contact our support team immediately so that we can investigate and take appropriate action.

AcePHP employs age verification procedures during the registration process and reserves the right to request documentary proof of age at any time. Accounts that cannot be verified as belonging to a person aged 21 or older will be suspended pending investigation.

12Data Security

AcePHP implements a comprehensive set of technical and organizational security measures to protect your personal data against unauthorized access, accidental loss, destruction, or disclosure. These measures include:

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, AcePHP will notify you and the National Privacy Commission within seventy-two (72) hours of becoming aware of the breach, as required by NPC regulations.

The AcePHP platform may contain links to other internal pages and resources. This Privacy Policy applies solely to data collected and processed by AcePHP in connection with the acephp.net platform and its associated mobile application.

Where AcePHP engages third-party service providers (such as payment processors and KYC providers), those parties operate under their own privacy policies and data processing agreements. AcePHP is not responsible for the privacy practices of third-party service providers beyond the contractual obligations imposed on them by AcePHP's data processing agreements.

14Updates to This Privacy Policy

AcePHP reserves the right to update or amend this Privacy Policy at any time to reflect changes in our data processing practices, applicable law, or regulatory requirements. When material changes are made, AcePHP will notify registered players via the email address associated with their account and will update the "Last Updated" date at the top of this page.
